Terms of Service

1. The service

TradePro ("we," "us") operates an SMS lead-routing service for home-services contractors ("you," "the contractor"). We receive Facebook Lead Ad submissions from forms you own, forward them to your phone by SMS, classify your single-letter replies (Y, N, or M), and report the resulting signal back to Meta's Conversions API. 2. Eligibility

You must be a business operating in a home-services trade, of legal age in your jurisdiction, and authorized to bind the business to these terms. The service is intended for use in Canada and the United States.

3. Your account

You are responsible for the accuracy of the information you give us at onboarding (business name, phone, time zone, lead-form IDs, etc.) and for keeping it up to date. You are responsible for any activity that takes place under your account.

4. Your obligations when contacting leads

When you reply to or contact a lead through the service:

You will not: (a) attempt to access another contractor's leads or account; (b) reverse-engineer or interfere with the service; (c) send spam, malware, harassing, defamatory, or misleading content; (d) use the service to violate any law or third-party right.

6. Fees and payment

Fees, if any, will be presented to you before you onboard and are described in the contractor onboarding agreement. Until billing is enabled, the service is provided to you free of charge as a beta product, and we may pause, throttle, or change service availability at any time.

7. Termination

You may stop using the service at any time by emailing david@trade-pro.ca. We may suspend or terminate your access if you breach these terms, if your continued use creates a legal or operational risk for us, or if we discontinue the service. We will give you reasonable notice unless immediate suspension is necessary to protect the service or its users.

8. No warranty

The service is provided on an "as-is" and "as-available" basis. We do not warrant that lead delivery will be instant, uninterrupted, or error-free, or that every Facebook lead will reach you. SMS delivery depends on third-party carriers and Meta's webhook reliability, both of which are outside our control.

9. Limitation of liability

To the fullest extent allowed by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost leads, or lost business opportunities. Our total liability for any claim arising from the service is capped at the greater of (a) the fees you paid us in the three months before the claim arose, or (b) one hundred Canadian dollars (CAD $100).

10. Indemnification

You will defend and indemnify us against any third-party claim arising from your use of the service in violation of these terms or applicable law, including TCPA / CASL claims arising from messages you sent.

11. Governing law

These terms are governed by the laws of the Province of Alberta, Canada, and the federal laws of Canada applicable in Alberta, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Alberta.

12. Changes

We may update these terms. The "Last updated" date at the top of the page reflects the most recent revision. Continued use of the service after a material change constitutes acceptance of the revised terms.
